about a year and a half ago me and my boyfriend got into a car accident and i didn't know i was pregnant yet. we went to the hospital and everything was fine but they didn't know that i was pregnant and didn't say anything. that was about april. it was a drunk driver in missouri that hit us.
so forward to august. i go to the emergency room with back pain. i tell the lady i'm pregnant and i think my baby is coming.
so they ask to see my STOMACH! she tells me that i can't be more than 5 months and i have to wait in the waiting room.
this nurse was nuts. i was hysterical i laid on the floor and cried i had blood in my undies and she wouldn't see me and yelled at me for laying on the floor.
well they finally had a bed open to lay me on the doctor checked me and guess what, 15 min later i had a baby girl.
alot of people tell me i can sue this hospital (it was the same one both times.)
what do you guys think?
it was a little over a year since i had my baby.

OH MY GOSH! How far along were you when you gave birth?? I would sue the pants off of the hospital AND the nurse who asked to see your stomach! Her job is to help people in pain, not analyze them!

Contact a lawyer if you are suffering some sort of trauma. If you aren't don't sue. I work for a bunch of doctors (accounting) and I have seen some ridiculous lawsuits come through (not that yours isn't legitimate). The problem with suing when there isn't really an issue is that it raises the malpractice insurance cost for all doctors and nurses. That in turn raises hospital cost, that raises the prices for patients and insurance companies, that in turn raises the cost of health care. It's a vicious cycle. But if you are really that bothered by what happened, sue. Otherwise perhaps you should do some reporting to hospital officials and demand some sort of punishment for the front desk lady. Good Luck!

My mother's appendix ruptured when she was eight months pregnant with me. My father took her to the hospital that night and the doctors sent her home saying that nothing was wrong with her. The next morning he took her back to the same hospital because she was still in a lot of pain. A different doctor discovered the problem. They could probably have sued (she almost died along with her baby), but waited too long to try to take any legal action.

OMG, do you not have health records in America? That is disgusting. Over here in the UK, they can find the medical records of a person by just entering their name in a database in the hospital, also, pregnant women are given a records book which they must take with them to all antenatal appointments and to the hospital when they are in labour.
I thought the NHS was cra*, but it seems the health system is worse in the USA.

I would definitely sue....

That is awful, you can still sue so do it now. My in laws had a terrible experience with the hospital they went to when my MIL was in the hospital. They are going to sue and the lawyer says they have up to 3 years to do so. I would get on that though.

Since you and your child end up OK. Thank goodness. I don't know what you can get. I would recommend just not going there and tell your friends not to either. If you really want to take legal action, you should speak to a lawyer and see if you have a case. They will know better than any of us.

Well if no harm came to the child as a result of their actions I have my doubts about being able to sue to get anything. if you wanted to you can always talk to a lawyer, often they will answer questions over the phone to let you know if you have a case or not.

You need to take action legal before 2 years pass. I think you have grounds.
