matters how it is performed. Any time you need personal information like SSNs, Drivers licence numbers etc, you need their permission. This is personal information that you do not have the right to have unless they give you direct consent to use it. When someone fills out a form and gives it to another that is considered consent to use any information contained on that form though unless they specifically state otherwise. Also just as a FYI for anyone reading this, if a job application states that it will be using a credit check as part of the interview process and they deny your employment based on that credit check, they are required to inform you what portion of that credit check was the reason for denying access to employment. You can also generally ask for a copy of the credit report from the agency they used

I guess it all depends what you're looking for. I do background checks to see if I live near any criminals cause I have a little girl so I want to be sure that we are safe. I know some people do it to find out if there other half has any secrets in there past that they may not have told you but would make a big effect on you. So it's not wrong it's a way for you to feel safe and secure and nothings wrong with that.

If an employment or credit decision concerning the person being investigated is going to be made based on the results of the search, then yes, it is illegal to do one without the person's consent. Otherwise, you can do the search without telling them.

Since prospective employers ask your permission, I would guess that it needs to be permitted. You would not have a full background check without permission, since the parties you were asking for information would be hesitant to give it without permission. Too many lawsuits to take the chance of giving info without permission.

I hope it's not. Anyone can do a background search on anyone they want and there's nothing warning the user that it's illegal.
