A guy that I work with is starting In-Vitro fertilization treatments with is wife soon.
He is out of days for time off from work. He tried to apply for FMLA to take on the days he needs
to go to the doctor with his wife. The denied him. Supposedly she has to incompacitated and need his assistance
for him to take off from work.

Has anyone else been through this... He is desperate for advice on this.
Is there any loop holes?
Please help.

He already got some paperwork from the doctor and turned it in. They still denied him...I think it is just bull.

He or his wife needs to call her RE--the one that will be doing the IVF. Have the RE write a letter the to the HR dept where he works stating that his wife will be undergoing IVF which involves a surgical procedure in which she will need assistance the day of surgery and the following day. And then again she will need assistance on the transfer day as it also involves a medical procedure. I can't honestly see how he can get any more than 3 days total but that would be better than nothing.


I just read your additional details that he already submitted papers from the dr, that really is bull. Is there any possible way your company would allow other employees to give 1 or so of your vacation days to him? I know it is rare, but I've heard of people actually doing it.

He may want to look at the attached form. I'm not sure in-vitro would qualify him under the FMLA, but he could always contact an attorney that specialized in family law. Good luck to him and his wife!

FMLA only applies to large corporations and businesses, I think they have to employ over 50 people. If your company employs less than that, they may not be required to let him have leave. Otherwise, it sounds like he's being treated unfairly. This definitely qualifies for FMLA in my book!

If the dr will write a note saying that he NEEDS to be there for whatever reason then they have to give him the days off....
