Why do you have to put your 8yo in daycare?
There must be a good cause for doing this if you want the Court to increase your ex's payments solely for this reason.
If the reason you are placing the child there so as you can go to boot-scooting classes, the gym or coffee with your friends - then no, the ex wont be ordered to assist.
If it is because you now have a job, your extra income will be taken into account when any new assessment is made.
It is not an open & shut case that the male has to pay extra .
How do you expect informative answers if you don't describe the details here?

In most states, yes. Because it's been a few years, you have the right to file for more support, and they will include the new cost of daycare. It shouldn't cost you anything, just go into the child support office, or call, tell them what you would like to do, and I'm sure they'll get you the forms for free. Similar to when you first filed. Don't go to the courthouse, however, because they will charge you for the forms and filing fees.

you can take him to court anytime for anything.. just remember that the judge can reverse any decision that he has made before, so you put some important issues at risk.. friend of mine got taken to court like that by an exwife.. my friend ended up with full custody and the ex then had to pay him the child support, so she lost a lot, and he gained a lot,, just because his ex was wasting the courts time..as the judge put it!
Think it over real good before you make a decision. Judges dont like the courts time wasted .

Depending in the state you live in, you can go back to court. Also if his income has changed in the past two years by 20% you can take him back also and ask for more. Call your local attorney general and they can assist you if you don't have an attorney

Yes you can. Your mistake was your lawyer. he should have covered all the bases. Wile your there, make him split the medical expenses and school expenses also. JUST IN CASE. when the kids get older, they willl have much more school expenses and maybe braces. you have to be prepared.
