It is my understanding that you may file for a patent with the schematic design, and don't actually need to submit a working prototype. Legally, you don't need to have a device, though, for practical reasons, you will likely have constructed something for testing.

Always best to run these questions by your patent attorney, however, as answers likely differ depending on the industry or patent applied for.
