I appreciate the comments I have received so far and yes, you`re right, I am really angry about it, but I`ve had conflicting advice elsewhere about whether or not it will survive without developing cavities and rotting and then becoming dangerous so thats really the sort of advice I`m seeking please. Thanks a lot..

As long as the roots are intact, it stands a good chance of growing back. Why did your neighbor cut down YOUR Tree? Did you ask him to? If not he can be in serious trouble. One cannot go onto anothers property without permission and just start cutting your trees...

While he has a right to cut back branches that over hang his property, he does not have the right to damage your tree and especially not to this extreme. Ideally he asks permission and the proper cuts are made on the tree .......not what was done here.

If you don't seek legal recourse, you can still have an attorney send him a notice that the tree is YOUR property and if he has a problem with branches on his side, if asked you will have it dealt with by a certified arborist.

If you want to be a bit more forceful and seek compensation, you'll need pictures of the tree before it was damaged and the poor stump now. An arborist trained in tree evaluation can then put a price tag on damages.

This is a good example of not putting a tree near property lines and especially trees that drop flowers or fuit.

Looks like you have a legal situation, if your neighbor wasn't given permission to prune your tree down like that, you have a ligitimate claim against him, take him to court and recover the cost of replacing that tree and hopefully he will learn his lesson. He had no business even messing with your tree, unless some of it was on his side of the property.

How sad! You should consider asking your neighbor to reimburse you for the tree he "TOPPED". Your going to have to dig it up..all that will happen now is it will send up suckers from the base in a last ditch effort to live...very sad. If it were a wheeping willow it would be appropriate..it would be crying for its own life! lol

I recommend for your neighbor to stick to hacking his own yard and reading up on the proper way to PRUNE a tree not TOP them.
