My friend and her husband are going through a divorce and they have joint custody. If the soon to be ex husband takes the kids out of state and doesn't return how would my friend get the kids back and can she. She believes he's gonna run with the kids to another state so she can' get the kids back, what's your advice? Please help.

Your friend needs to hit the local bookstore... Barnes & Noble or the other ones... and get the DIY divorce guide for Texas. There is one that deals with child custody and related issues in detail. That's the intellectual thing.

If he hauls off with the kids without it being approved by you and through the courts, it is kidnaping. She should probably go see the judge to seek primary custody of the kids.

I agree with the guy above that's kidnapping. And no it isn't good....

If hubby takes kiddos then yes, there is a link through states, he would never be able to get a drivers license again. or pay taxes... he better be able to live in the middle of nowhere feeding kids. Because if he ran the feds would show up. kidnapping across state lines isn't cool. It's a federal law. which means state does not matter. It'd be okay if he does not mind the FBI breathing down his neck. This kind of behavior ranks up there with pedophiles and unless he wants that kind of heat he'll behave.

She should do the same. Ask the court to take them out of state if that's what she needs. Meanwhile, no kidnapping okay?
