Smoking? As in cigarettes? That's not illegal at all. Unless you specifically pay extra rent for a smoke free environment the best you can do is ask them not to smoke where it may drift your way. But they have a right to smoke cigarettes in their own home.
However, if you're speaking of "illegal" substances, then yes you have a leg to stand on.

I am trying to figure this one out myself. Having just moved to an apartment the neighbors downstairs smoke on the back balcony. This is horrible for me as I can not have windows open at "any" time as I am filled with smoke all the time. Is there is this legal? I live in a city where smoking is banned in bars and such but what about apartment homes on the outside?

I don't think so in your own home or apartment. But I see you are smoking and this is a public place or is that a white pencil? lol
