My brother is locked up and has been for 3 months now with felony burglary charges but they haven't indicted him yet. How long will it take before he will be indicted or is it lawful for him to sit in jail until they finally decide they don't have sufficient enough evidence to convict him. Also is there something we can do to speed the process along?

He has been in front of the judge for a bond hearing and bail was set enormously. The last time we were in court was for a bond reduction, in which case the judge didn't reduce the bond because according to her ".....because of the home environment he was in he'll likely do the same thing". They don't have him down for any upcoming court dates according to the DA's office. Plus at first he was offered a plea, he signed it, but the DA took it off the table. Now we're just waiting. My family can't afford a $10,000 bond....yes, bond not bail. That $10,000 would be the 12% we'd pay to a bonding company.

Has he gone before the judge yet? Was bail set? It sometimes takes months before the actual case goes to court. If you want him out, you will have to come up with the bail money and make sure he keeps his nose clean until the trial.

Good lawyers speed the process along. The ones that cost a lot of money. It can take years before he is indicted. The time spent in jail will be counted toward the sentence time.

Nope and nope. Your brother probably already has a case on the docket, and it will come up as soon as the date gets here. The courts are SO backed up these days, he will probably sit for up to a year and there's nothing to do but wait. However, if he is convicted, they will use the time he is sitting as jail time already. That's one good thing.

This varies from state to state,they can usually hold him for quite some time before indicting him as long as he is charged with acrime and has been arraigned . it took afriend of my family 1 year before he was indicted . the specifics of the crime also play apart ,good luck!

It is called right to a speedy trial ask any attorney anad they will explain it for free.
