Party A backs out of a parking space as Party B rushes to get around party A knowing party A is backing up. Party B stops vehicle directly behind Party A, does not blow his horn but says with the window rolled up "Stop! Stop!" as if anyone could hear. No police or other officials were contacted and both parties left the scene exchanging only phone numbers. Who is legally liable for any damage incurred?

party b - but considering both parties left the scene - party a and b will have to deal with party p - ( police ) - because that is leaving the scene of an accident - and unless one admits total fault to their inscurance and in court - you two will not have fun sorting this out -

( yelling stop does not make party a liable because party b rushed around the other and stopped behind him )

Party A...doesnt matter what Party B did that was stupid, Party A has the legal responsibility to look behind him while backing out, and be in reasonable control of vehicle at all times...Party A would be held responsible in court, so if you are Party A i suggest being as reasonable as possible and see what kind of deal you can make with B....if you are B take him to court, he is at fault.

Party A will be held liable. The amount of damages will be equal to the reasonable repair cost of both vehicles/.

If no witnesses and no one admitted responsibility, the insurance company divides claims 50/50.
However, to make a claim, you must file a police report and give the report number to the insurance.

Police reports don't determine fault in a traffic accident, anyway. They only document the facts, which are not really in dispute here. Contact your insurance company, they will determine fault.

My guess is it will be 50/50.

Usually, insurance companies determine fault on their own. If you disagree with their determination, you can file a lawsuit, but for such a minor accident it will probably cost more than it's worth.
