I bought my house one year ago at the time the then board president told me that they dont enforce the no commercial vehicles in plain sight rule.Well one year later new president,ECT........

They may not be able to make you move, but they will fine you and eventually put a lien on your property (which means they will then have an interest in your property equal to the amount of $ you owe them). You won't be able to sell it until you clear up the lien. The will continue to fine you as long as the problem exists. If the covenants state that you can't have the vehice in plain sight, you can't. Don't know why you would listen to someone "who told" you over what is written.

You knew the covenants did not allow commercial vehicles whether the board enforced it or not. Therefore now that it is being inforced you have no rights other than what the covenants say you have. Nothing has changed. You just got away with it for awhile. The board is within their rights to ask you to remove your vehicle. A court of law cannot change that. HOA's have inclusive rights for all they ask with the exception of certain state laws which they know they can't enforce. They always stay within those perimeters. You will have to move your vehicle off site or you will pay penalties determined by your HOA. They won't force you to move but they could put leins on your home if you don't abide by the rules.

Can they make YOU move? No. Can they make you move the VAN? Maybe, it depends upon the restrictions and the circumstances. If you were told BEFORE you purchased that the restriction would not be enforced, then you have a great case. If you were told the restriction would not be enforced AFTER you purchased, then you may still have a case.

They can put a lien on your house, fine you, etc etc HOA BS.

If you dont have something in writing... you are SOL.

SOLUTION: Get some of those giant magnates.... the kind that real estate agents and others stick on the side of their car that advertise, except yours are BLANK, just plain old white.

Then, when you get home, use the giant white magnates to cover over the lettering on the side of your work van.

I dunno... worked for a friend of mine. :)
