The person whos car I hit is refusing to pay anything, even though his car was in my driveway which I was unaware of... This occured late at night, so when I backed my car out of the garage, the mirror on his car snapped off. Should I take this to a small claims court or just pay for his repairs?

Citicop - neither actually... He parked his car in my driveway without my permisson... And when I backed out of my garage I accidently ran into the side of his car, causing scratches and his mirror to snap off..

Yes you are. Your insurance should cover it though.

I'm confused. You damaged it on purpose while it was on your property without your knowledge?

Or did you know it was on your property, and *accidentally* damage it.

Either way, you are responsible for the damage you caused to the car.

I believe so but you may want to check with your insurance company and an attorney just to be sure.

Morally or financially? Either way I would say yes. You break it you buy it.
