Depends on the state - if it is a no-fault divorce/community property state, why they are divorcing doesn't matter.
He cangive her the house, doesn't mean she won't still go after the practice. There is no guarantee unless she signs an agreed order.

I know it's a horrible thing and I don't agree with it but, from what I'm reading he left the house correct? As soon as he walked out of that house he made the biggest mistake possible. She can get him for abandonment now (unless he immediately filed for divorce). She will now be able to keep the house and get half of the dental practice... plus if she didn't work he will also have to pay spousal support. Also if he left the house she has every right (according to most states laws) to move anyone she wants in there. Unfortunately he will be paying the price and supporting her new life. This is not a personal opinion, this is just how the law works... been there done that. I would have him get a very very good lawyer A.S.A.P

I think hes also trying to use to nice factor. Thinking if i'm nice enough she'll come back. I'd say if someone hurt you that bad. Get a lawyer and get on with your life. He is being to nice for his own good right now. You can love someone but you can't get runned over. If hes a nice man like that' he'll find another women. Hopefully a worthy one this time.

No, it is not right. He should not give her the house until the court says so. She will try to get half of his dental practice sooner or later. I hope he hasn't signed anything yet. He needs to get a lawyer ASAP.

Sad but mostly true. Cheating does not stop her from getting her half of the equity in the marriage. However, he needs to talk to an attorney, different laws for different states. Does he have children, how long were they married.
It is just easier to walk away quietly.

If this went to trial, and it was proven that she did cheat, the jury would definately condemn her.... However please bare in mind that depending on how ur brother is handeling this, taking this to court might not be the best idea, it takes time and effort, and although she does not deserve the house, if ur bro believes this is the best option just support his decision, there might be details u arent aware of... my advice is open up the subject with him about whether he wants to take it to court, if he didnt think its a good idea just drop it... best of luck.

This woman has commit ed adultery and there is lot that goes for this she could loose her rights as well. first of all he is entitled to half of everything they made doing their marriage life together. if he thinks she will leave his practice alone he better get a lawyer and get it straight.

Have you and your brother both lost your minds.GET A GOOD LAWYER and don't do anything without his advice.Any negotiations you do without proper council may cost your brother dearly.Tell your brother not to even talk to his wife without a lawyers advice.Good luck even with the best of lawyers your brother is going to have one big headache.

i don't think the courts um do anything special for the spouse that was cheated on it really isn't a big deal anymore as far as divorce court goes!! so most likely she will get half of everything but he shouldn't be handing things over on a silver platter!! she is abusing him maybe he can say that he is mentally abused by her i think that should count for something!!

She'll get half of all marital assets. If she didn't work she may even get spousal support. What she did was a horrible thing, but these are the lovely laws we have here.
