After my husband cheated on me many times, I decided to divorce him. I have filed for divorce in VA and in the process of moving to FL. My lawyer says I can bring suit against him in either state. I was told FL will try to force couples to reconcile first and VA will not, but VA favors the men more than women. I want it to be quick I need to know which state would benefit me more to file the suit in?

My attourney said I can file in the state I am moving to, which is Florida, or the state I am moving from, which is Virginia.

You can't file for divorce in Florida until you establish residency, which would be 6 months or more...if you file before that time, he has the right to request a change in venue.

so I suggest you file in VA.

Florida is a no fault state, so they don't care if you try to reconcile or not. Also, I went to the court with a friend to get her divorce finalized, and from watching, it appeared the judge checked everyone's Florida license to prove that at least 1 of the people lived in Florida for 6 months. I don't know how long it takes to get to the finalized stage, but if it's less than 6 months you are in trouble. You have to be here (Florida) for at least 6 months apparently. Good luck.

I would file in Virginia because it will be easier for you to make necessary court appearances.

No state really favors either sex, it depends greatly on the situation and the judge.

I live in MI, which is supposed to require marriage counseling before granting a divorce if there are children involved. I went before the judge 3 months after filing and my ex and I explained that we had been living apart and that we were firm in our wish to divorce. We both told him that the marriage could not be saved and we agreed on the children being in my custody. I had my divorce papers in my hand 30 minutes later.

You will proberably be better off filing in the State of Virginia. Florida is a No Fault State...It does not matter who's fault it is, the court will just file your petitions to be done and over with..
