I was in a car accident while driving a company auto. X-boss was sued and had to pay the other party because car had no insurance. Now, he wants me to pay him. He threat me to take me and my husband to court. Can he really do that? I paid the fine for the accident, but it was his car with no insurance.

It is up to the car's owner to ensure that the vehicule is ensured. First off he can sue whomever he wants. The outcome of such an action, however would probably result in thew case being dismissed because he has no reason to sue your husband, and in order for him to be successfull against you, he would have to prove some form of negligence on your part. He necessarily would have to prove that you knew that the car wasn't insured, and quite frankly that would be next to impossible.As a matter of fact it would seem to be a reasonable assumption that a company vehicule would have proper insurance.
I think the ex-boss is blowing smoke and trying to intimidate you. Tell him to take his best shot.

It is very possible. I do not know his chances of winning the suit though. You should probably get a lawyer. You need someone who is well versed in the law and can advice you as to what the facts are. If the guy is suing you, then a lawyer is going to be a very good investment on your part.

He wouldn't win if he tried. It's the car owner's legal responsibility to make sure his car is properly insured, and that the policy covers anybody who is going to be driving it. If you want, you can even get his license plate number and report him to the police and the DMV for letting the car be driven without insurance.

He can do nothing, it was his fault for not insuring the vehicle. Just as long as you never signed something stating that you drive the car at your own risk, and verified that you carried insurance. It souns like the X is a slimeball and would not have been smart enough to have you sign anything like that.

Only if you can prove that your breathing problems 1. started with the paint, 2. never happened before the paint, and 3. were caused by the paint. That will be hard to do, especially if you didn't go see a doctor right when that happened.

I'm not sure be he/she is liable for his employees, if you were on the clock he/she is liable.......if you were using car for work purposes, he is liable. Dont let him scare you, lots of prick bosses out there. I do not believe this is possible, he is only intimidating you. Seek a lawyer......but yes as said above, i believe you can counter sue, threaten him with this and see how far X carries this.

Exactly. I think you are in the right here. But he will sue, and if he gets an expensive lawyer, you may be in trouble. But I wouldn't be too worried.

Anybody can sue anybody. The Bar Association often offers pro bono (free) consultation..

I believe you can, it is your job as a driver to be sure the vechicle you are driving is insured. Or you have a blanket policy that covers you while driving other peoples autos.

No he can not you are not legally responsible for his vechile not being insured. I would not worry to much about this. the courts would laugh at him & through it out before it came to much of any thing. He's just pissed off & wants to take it out on some one.
