When he broke into the hotel room where his wife and the cop were staying, he switched the guns. That way, he used to cop's gun to kill her. Then, when the cop came to negotiate, he had him put his gun down. He then switched them back when the cop wasn't looking, so that the tests would show his gun had never been fired.

Anthony Hopkins had an identical gun to the cop's. He went to the hotel room whilst they were in the pool, and swapped them - so the cop had his gun and he had the cop's.
He used the cop's gun to shoot his wife and fire through the window.
When the cop came in, he put down the unfired gun. Whilst he was bending over the woman, Hopkins swapped them back. So Hopkins had the unfired gun, and the cop had the murder weapon.
The cop used that same gun to kill himself.
It was still with his things when the lawyer went to look for it. (And apparantly still had bullets with Hopkins fingerprints on them.)
