Absolutely!! Most Judges would be concerned that if she did have custody the child support would not be used for their benefit or that they would be denied certain enjoyments in life because mom prefers to lookout for herself other than the children. This does depend alot on what excuse she comes up with for "needing" the money as I'm sure she might have tried to put it. Depending on the age of the younger kids, I know in Georgia at 14 they can choose who they want to live with and unless shown unfit the other parent doesn't really have a say so. Does she have any other history of this type of behavior, what are the living arrangements like, these are all things I would DEFINITELY bring to your attorney's attention and let him run with it. Not sure but the judge has to consider that if she stole from her 18 year old child what is she going to do with the child support for the younger children.

Was he with her?...if so then hell yes, if not and she is making the necessary changes and doing what she has been told to do, then it is iffy. Think long and hard before you try to get sole custody, it is often not good for the child at all.

not at all...i just got custody of my children after a 6 year court battle. and my ex beat my kids to the point one was in the hospital, very hard to get custody away from a mother..keep fighting

her criminal record has nothing to do with child custody. you can certainly used that against her in your case, but also keep in mind that all children need both parents when its possible. she has made a mistake which we all have done. should she pay for the mistake for the rest of her life. stop thinking about yourself and trying to hang her and think about the best interest of the child/ren. If the conviction is over 5 yrs old probably not if
there aren't any other convictions. Otherwise,
how could this not be an issue of her fitness
to raise kids?

If she will scam one child, she will do it to another. Bring proof of it and also check for her using the other children's social security numbers to get utilities or loans and other such things. Good luck. She should not be responsible for the other kids.

It better because that is horrible!! She doesn't deserve to have custody over those kids if she would steal from them!! Good luck!! Make sure they know about that!! Ask your lawyer, (S)he should be able to tell ya!

yes it does when the court goes back and looks at your actions in the past they tend to bring up anything bad,and if someone eles wants the child you really need to have lots of ppl sayiny yuo have change ,
