The supposed events you describe could have taken place more than 100 to 120 years ago. If your grandfather is 70, then his father could have been around 90 years ago, and the grandfather before that around 20 to 40 years before that...

Remember. No cars. No phones, no radios.

Someone broke into your house, you'd HAVE to believe he intended to kill you and take your stuff. You'd know that No One was going to come and help you. You'd use whatever force needed to save your family. Then you'd make sure your stuck around in case the bad guy had help hanging back waiting for him...

The next morning sounds like an excellent time to go looking for a police officer or a sheriff.

Probably your grandfather didn't lie but his own father or grandfather could had lied to him. To let the guy "hanging over the fence" sounds too weird, but of course it's possible.

I don't think you can find any details; that was so long ago (if it really happened); if you at least knew the dates and town of the incident you could check old papers (if available).

1) Depends on the state, as in some you are within your rights to use lethal force on someone stealing from you.
2) Leaving him until the morning and not reporting it, nowadays, would get him into SERIOUS trouble.
3) As the first poster said, if this were your great grandfather or great great grandfather, the times and laws would be MUCH different than today, so it's not unbelievable.
