this happened to my cousin and im trying to help her out. Okay so she and her mom got into a very heated argument and it got to the part where they were throwing stuff at each other. So my aunt got scared and called one of her friends whose husband is a cop. Well instead of her bringing her husband over, she braught over her 18 yr old daughter and her friend. Mind you my cousin is 14 and very small im talking 4'9'' and about 80 pounds. So she braught her daughter and friend to beat up my cousin. I was just getting there when one of them told my cousin,"come on why don't you come and try to hit me, come on take your anger out on me" then she launched herself at my cousin. My question is can my cousin sue that lady and her daughters for doing that and could her mom get in trouble for letting it all happen without saying anything?
please help me!!!

jesus- this is one of those cases that ends up on tv court/ dr. phil

it seems to me, if your view is unbiased, that your cousin does have a case

However, it goes deeper than that. Your cousin will have a tough time getting a lawyer/ all that stuff if her mother doesnt help out. Then you have to go to the authorities and complain about parents, which gets ugly a lot. If her mother does want to help out, you have a very good chance because the attackers aren't in any legal way in control of your cousin.

Also, I don't know what you consider beat up. If your cousin had to go to the hospital for stitches or something, then you have a case. Black eyes and bloody noses also work. If they just pounced on her, you don't have a good shot in court because they will just say that they were holding your cousin back.

this should turn pretty interesting

It definetly is assault though. Contact the cops and tell them what happened, and the 18 year old will be tried as an adult, where she could face a little bit of jail time.

nothing you can do. her parents should have called the cops at the time of the incident. no report then no case in court sorry

report this to the cops and see what happens after that. suing? maybe not. but assault charges, yes.

suing? idk about that. but it is assault.. whoever threw the first punch could be arrested depending on how bad the damage was.
