No. What you have to do is file the injured spouse form. It will help you calculate what portion of the tax return is from your income and which is from his income. Then, they will take his portion of the return and send you your portion. The process takes time, usually about 30-90 days for you to get your return.

If you fail to file for your portion of the return, they can and will take your money.

Explain the situation to your tax preparer and they will fill out the form to be sent in with your taxes to speed up the process.

My friend just ran into this same problem with her husband.
Yes, if you file jointly, they will take it.
My friend and her husband went to see a tax accountant.
They had to file separately, they still took his part, but not hers.

yes they will even garnish the entire check. The only way for you to have you income tax money back is if you file separately not joint. the same way applies to Student loans.
