not sure on the laws were you are but in Texas yes you can in tell you go to court the first time you both have equal right to your kids the cops just tell you its a civil matter not a criminal matter so get a lawyer ask him or her then do what thy say and good luck in the divorce

Depends. Is she abusive? Do you have somewhere to go, will your son be taken care of, do you have a job, what are your intentions for him with respect to visitation rights for the mom?

I assume there is no separation agreement, so there are no court ordered stipulations with respect to what you can or cannot do at this point. If it's a matter of the child's immediate safety, do it. But if it's just a matter of parental disagreement, do not do it, you won't be doing anyone in your family a good turn.

depends on the laws in your state. talk to an attorney. In California, you can, but you have to be prepared to reliquish custody in the event she can prove to the courts she's a better parent. and you cannot move a certain distant from the original home of the child. your actions have to benefit the child and not because you are doing something to get back at your wife. because that will be brought up in court, using the child like a tool.

Dont take any answers from here, get a lawer and see what the law is where you live. you dont want to goto jail for kidnapping.
