I live in Illinois and do not have maternity benefits, can I collect unemployment during my leave?

Nope. You are on your own. If you are laid off while on maternity leave, you can collect benefits after your 'official' time is completed if you were otherwise eligible for it. CA is possibly the only exception, but I think you are covered under disability there, not unemployment.

No, you cannot collect unemployment during maternity leave. Also to the person who said to ask your employer to lay you off for 12 weeks ... that would be fraud. Plus you wouldn't have your benefits (health insurance etc) if you were "laid off". If you quit your job, you still wouldn't be able to collect unemployment because you can only collect if you are fired or legitimately laid off.

A lot of women have to go unpaid during maternity leave. That is something that has to be planned for or just dealt with when it happens.

I am unpaid leave now since I am in the hospital until my baby is born. I have been here for almost 5 weeks and I still have about 2 weeks to go. I ran out of paid vacation and paid sick time. I will be unpaid during maternity leave too.

Good luck.

Talk to your boss. Ask them if you can be "Laid-off" for 12 weeks. If you are a good employee they may consider doing so. You could then collect unemployment as long as you keep up on the "Job searches".
