1. Most ROMS that people want to play are indeed illegal to download. There are a very few public domain ones, though.

2. Technically, modifying the ROM is not illegal in itself. Redistributing it is. Many "ROM hacking" sites, like http://www.romhacking.net/ can get around this because they do not distribute the hacked ROM, but rather a patch to make the changes to your own copy.

Modifying and downloading of ROM's is illegal. It is the same as downloading a book or music. It is copyrighted.

depends on if it is open source or not. bioshock is open source and so is quake 3 and the other series. halo 3 is going to be the first of the halo series thats going to be open source. halo 3 is intentionally edited sourced: seriously.
