Can a live oak tree with branches hanging 25 feet over neighbor's wall and swimming pool be trimmed by that neighbor. Also is there a protected species ordinance or law concerning live oaks in incorporated areas of Los Angeles County

The neighbor can trim straight up the property line if he wants to.

Before you or anyone you call picks up a saw call the L.A. county offices to see if there are any limitations or ordinances covering California Live Oaks. If there is the county will want to see the tree and know exactly how to intend to trim it. If there is not any limitations then you may have the tree trimmed so long as it doesn't harm the integrity of the tree (make it uneven and possibly fall over) or cause it to die any other way .I live in Ventura County and they nave a pretty tough stance on what you can and can't do to these trees .

Generally, any part of your tree hanging over a neighbor's yard can be trimmed by that neighbor. And he isn't supposed to throw the branches back in your yard because they are his. He is not allowed to kill the tree by trimming either.

Don't know about live oaks being special, sorry.

It seems only fair that you allow the neighbor to trim the section of tree that is invading their property. I don't know what the laws are but common sense and respect for thy neighbor should be all you need. They should ask first and you should allow it.

you'll have to contact your village to find out how their ordanances work. i would think it could be trimmed by whomever's pool it's hanging over.
