Both, as it suits them. Both whip it out when it suits them as well, but it's my belief that the vast majority of the legislation that has come out of Washington in the past 70 years violates the spirit if not the letter of the Constitution.

I think it would be a rather laborious job to determine which party does the "most" damage. They're both guilty in their own way, both do Earmarks, request Pork Barrel spending, and generally ignore the true majority of citizen's true interests. The Democrats try to take away from productive people to "help" the unhelpable, and the Republicans give unneeded tax breaks and perks to Big Money corps. who are continually degrading the worker's paychecks and inflating the corporate officer's pay beyond what they're truly worth. I can't say how either one of them work to the advantage of ALL Americans, they're all targeting whichever group gives them power ( and donations for political support ).

I think it's equal. This is a Republic. we elect our leaders to do the right thing, right? However, both parties are so obcessed with partisan politics, that this is not happening. Abortion is still legal, and violates even the Preamble to our Constitution (secure the blessings of our posterity, which means you probably shouldnt kill off the posterity). The Patriot Act, although good on paper, has been violated by the Administration. I want to fight the terrorists, but you dont want to invade the privacy of true Americans.

Well let's see, the Republican party stands behind the Totalitarian Homeland security Department, the largest government program in the history of our country and they would like to have abortion made illegal, not allow diseases to be cured by outlawing stem cell research, make a human being die painfully and in an undignified manner by outlawing euthanasia and being allowed to wire tap anyone's phone regardless of cause or permission, which party do you think tramples the Constitution the most? It's a no brainer...
You Ask: once again you have proven that the right doesn't care about individual civil liberties and guess what? Death is part of life, you'll find that out someday...of course you won't address stem cell research because you're obviously a bible thumper...

Historically it would be the Liberals...they are always lobbying to change something in the constitution to suit minorities (ex: gay marriage is a current one) no matter how the rest of the country feels about it...they rewrite the constitution as often as they can and since they have aligned themselves...or taken over the democratic party...that honor now now falls on the democrats. Most Republicans are strongly against anything that alters the constitution in any way that is detrimental to the rights of the individual...even the liberal interpretations of it.

Spirit...aside from wiretaps, everything you mentioned about republicans, is them trying to stop democrats from killing...abortion, euthanasia?? Ever hear of LIFE liberty and the pursuit of happiness...that one isn't that hard to understand!

They BOTH do.
Bill Clinton expanded FISA to include warrant-less physical and electronic searches.
George Bush instituted the Patriot Act to eavesdrop on phone calls and read private mail and hack into computers.
And now Congress has approved the Patriot Act being legally used domestically!!!!!!!
The 4th Amendment has been highjacked and dismantled by BOTH the Democrats and the Republicans!!

You're asking a question that more or less asks who the lesser of two evils are.
On one hand you have the Republicans: They apparently have no respect for the consitution, civil liberties, personal liberties, or liberty of any kind when it comes to "safety and secuirty."
On the other hand you have the democrats: They would love nothing more than to wipe their asss's with the consitution, raise taxes, and create a socialist state.
Our forefathers must be rolling over in their monuments right now seeing republicans spying on US citizens while democrats want to raise taxes in order to create more communism and socialism. 100 years ago this country didn't have 1/4 the taxes it has now, no national debt, the largest middle class of any country in the world, and we weren't the world police with everybody hating us. What the hell happened????

The GOP.........they seem to be the ones who think they are above the law.Simply consider the Libby case.After being convicted of perjury he was sentenced to 18 months in jail.Bush decided that the punishment was too severe and committed the sentence to a fine and probation!Also consider Rove admitted that he spoke to a reporter about Plame being in the CIA and nothing was done to him!I thought that outing a CIA operative was ILLEGAL!

look at current events and you will clearly see who. Democrats, who only hold a slim margin in congress, thus not enabling to do anything, only wishes to provide for the people, which is what the government is desighned to do. Republicans care much more about the upperclass, and insist "people are poor because they want to be poor". If you look at how Cheney has interpreted the consitition, sayingthat because the vp's office is the "president of congress, and it is apart of congress not the executive branch. Even the illegal wire tapping is an invasion of privacy.
