There's no law against it. Usually, there's a statement on the menu or it's posted someplace in the restaurant that the tip will be included. If it's a large party, you can pretty much count on it being added. Don't go back if you don't like the policy.

As a past server myself, I definitely think the tip should be included with LARGE parties (6+). There is a LOT of work that goes into it, and people tend not to tip percentage-wise on larger groups.
But as a side note... if you feel your service wasn't deserving of the tip that is included, you can ask to speak to a manager. 99% of the time, the manager will remove the gratuity if the customer is unhappy with the service. Even sometimes add a free dish or something on there.
Included gratuity is just the establishment's way of ensuring their waitstaff is being appropriately compensated. The minimum wage for waitstaff in my state is $2.33 per hour. Would you work for that?

Yes I think a resturant should. Many people do not tip right. This is 2007 not 1950. Most servers in many restaurants do not even earn the minimum wage. Also, servers should be require to report all of their tips so it can be indicated on their W2 forms for income tax purposes.

It should be required. A lot of people, like some of the answerers to this question, do not understand that in American etiquette a tip is ALWAYS required. Leaving no tip or a very small tip is equivalent to saying "F*** YOU" to the server's face.

Incorporating the tip into the bill itself would help out a lot of servers who have to wait on some of the incredibly rude people who answered this question.

No its not acceptable to me. the tip shouldn't be a guarantee for waitstaff. the tip is a tip. its "extra" depending on the service i recieved. i don't think its fair at all.

but i must say, i went to an applebees where the tip was included(after11p, NYC) and the waitress did deserve every bit of it and more. but if you do go to a rest. where the service isn't good and tip is in the bill, complain to the manager.

No because sometime the tip is cut of for the waiter

no. What if you waiter or waitress was rude and didn't do a good job. They don't deserve a tip and it wouldn't be fair if the restaurant made you give him or her one.

no, it isn't right because most people are use to giving tip to waitress/waiters after.

This is not acceptable to me ... I think we should have the freedom to tip whatever we feel is fitting.
