I know you have to be 18 to buy cigarettes, but what happens if a cop sees you smoking under that age? Could a 12-year-old get in trouble if they were caught smoking?

In CA, Yes. Its still possession.

Not in Massachusetts (unless they were smoking on school grounds or other non-smoking areas), but I think that every state has its own laws for that. But the cop might tell their parents and get in trouble that way.

It depends on where you live, I believe. In this state, it used to be that you could possess tobacco but not buy it, then that loophole was closed.
And a smoking 12-year old already has trouble.

Common sense, and concern for your health would tell you not to smoke at any age, but then because of your age, I guess you haven't listened in Health classes.

Don't smoke, then you won't be in trouble!

It's called "Minor in Possession of Tobacco" aka MIP. It's illegal in most if not all states. It's up to the cop if they want to write you a ticket or just tell your parents.

You get charged. It is a crime and probably petitioning the court for a Juvenile delinquency hearing!
