I am about to get a divorce with my husband, but he refuses to leave the apartment. He is illegal and i started the process with immigration to get his papers, but I cancelled it. I think he just wants to stay because he has nowhere else to go. One of the reasons i am seeking a divorce is because of his violent behavior and sometimes physical outbursts, which i have pictures to prove. I guess i can go to the police and get a restraining order but that would definitely leave him no chance of getting his papers at all in the future. I'm not sure i want that as that would totally destroy his future and who knows what he will do if i do that to him. I just want him out with no drama. What are my other options? I live in new york...i have the lease in my name only...can i get mangement of the apartment to kick him out? I wish i knew more about the laws so i can know what to do in a situation like this...please help!!

The only way to get him kicked out legally is to get a restraining order and then when he doesn't leave, contact the police, tell them you have a restraining order, and he won't leave and then he'll be arrested.

Since it's a matter between you and your soon-to-be-ex husband, it is unlikely that management will kick him out.

Does he ever leave the apartment? If so, change the locks right away.

Otherwise, break the lease (you'd still be liable for rent) and move out.

there is no longer something you're able to do to get him out. Your call must be on the lease, yet he's likewise your husband, so he has a ideal to be there, till a separation order says in any different case. the only element you're able to do is touch the administration, see in the event that they permit you to wreck your lease, you'll be able to could arise with a settlement quantity, and you progression. You call the police on the time violence is occuring or interior of 24 hours, no longer weeks or greater after the reality.

Well, I know in Texas, if his name isn't on the lease, and you don't want him there, you can let the land lord know and they'll be obligated to force him out. I'm not sure if it's the same in NY or not. If that doesn't work, then report him as an illegal, and they'll deport him. Which I know doesn't sound like the best idea, but would you rather have him deported, or have him hit you?
