she lived with me for 2 months then her boy friend wanted her to move out. She had no one to help her get an apartment, her credit was bad. I signed a year lease for her. She paid all her bills off then skipped out on the last two months of the lease, now I owe 4,000.00 something dollars to an apartment complex. When i requested the money from her she threatened me with a restraining order that she would get me for harrassment

Well, this is just great isn't it. No good deed goes unpunished. Did you have her sign any sort of contract. Sounds like you know where to contact her. What I would do, since we seem to be in a threatening mood, is to threaten her back. I would prepare a letter stating pretty much what you say here (leave out the part that she paid all her bills off). Also--give the name of the apartment complex, the terms of the lease (the duration and amount of rent). If she was with you when you signed the lease, state that, the date and the name of the person at the leasing office, who is your witness to the agreement you have with her (you have a witness). Tell her if she doesn't pay you (or the apartment complex) for the remaining rent of $4,xxx, by (decide on a date), she leaves you no choice but to turn the issue over to your attorney so she can begin the collection process against her as well as making any necessary contact with approrpriate credit bureas. Send two copies of the letter in separate envelopes--one regular mail and one certified, return receipt requested (she probably won't pick up the certified letter and the post office will return that to you--that's okay, it will only work against her). The post office can help you with the certified mail process.

If she doesn't pay up, then see about the civil suit or small claims court--I don't really know. First, give her a chance and then go to the clerk of the court or get an attorney to see what the next appropriate action would be. Good luck. See why kind, generous people get cynical. You try to do the right thing, and you get screwed over. You gave her a boost/hand up so she could get her life straight and this is what you get.

I wouldn't phone or e-mail her any more or try to talk to her.

Call an attorney or go to small claims court. You were nice enough to help her out & do her a favor & you should not take the loss, especially $4,000! Make sure you have documention because if you sue her the burden of proof is on you. Do you have any emails or voice mails or anything signed by her saying she owes you the money? Any witnesses willing to go go court with you? Verbal agreements don't often hold up so you have to have your facts straight, without proof it's your word against hers. Your attorney might be able to supeana her bank records showing she paid the rent all along and that might be enough to prove that you had a verbal contract. Or if you don't want to pay for an attorney, you can go to small claims court & ask the landlord for copies of the receipts they gave showing she paid the bills or see if the landlord will testify.

Watch Judge Judy...she has cases like this almost daily.

Do you have a signed contract that she would pay you the money back? If not then you don't have a leg to stand on. You signed the lease, you owe the money.

Yes, pursue her civilly. By the way, that restraining order would not have stood on those grounds because you were attempting to collect on a debt.

You are well within your rights to sue this ungrateful wench. Simply go to the small claims office and file suit.

The BS about the TRO and harassment is just that...BS.

You made you attempt, now file and let the courts decide. At this point though, I would not call her or contact her in any way.

whoa friends like that who need enemies. I really hate when ur a nice person and a friend takes advantage of u. I would take her to court she needs to pay for it!
