so about 3-4 weeks ago, I ordered something from ebay. It still has not arrived. At first the seller said he sent it a few days late and that it would be arriving soon, but still, not here. I checked the USPS tracking number, and it said the package had been delivered in my area code, so im thinking that he just screwed up the address. Now, I think he is ignoring me, because he thinks it was delivered, so basically i cant communicate with him. I escalated a dispute in paypal, but I'm not sure what will happen.
Does anyone have any experience in this situation, or can someone offer some advice?

Unless he can provide proof of delivery, you will win PP dispute although you will lose some of the money to Ebay/Paypal - in the UK it is £15.00. DON'T close the dispute until you get a result - his PP account will be frozen so he might just decide he can communicate with you!!

Not quite the same but ..............
I bought something off Ebay from an individual here in the UK.
She never said that she posted it - she just cashed my cheque and ignored all communication - after three weeks or so of me trying to get her communicate - and going down the route of asking Ebay for a refund (which was about 5% of the money lost) - I sent her a totally bogus letter to her home address (where I had sent the cheque) informing her that I had filed under the Small Claims Court in the Local Court quoting ridiculous sub-sections of laws apertaining to 1926 (Theft and Miss-Selling) ALL RUBBISH but it sounded very convincing - also stating that I had reported it to the police as theft of cheque.
It did the trick and I got my refund about 7 days later!
Sometimes you got to play as dirty as they do!
I understand that it is the sellers responsibility to ensure the item gets to you -he must be able to tell you what address he used - contact him outside of Ebay - letter, phone - whatever. If he put the wrong address on it - which he must have or it would have reached you - at least you coud find out where it went.
Sorry I can't be of much help but I do wish you luck - and by the way -the previous comment that said Ebay was 80% rip-off - the above was my ONLY bad experience in about 5 years of trading on Ebay - buying and selling.

If you bought the insurance, the seller is responsible, but since no one ever does, you are responsible.
We bought a camera last Christmas. It was over $1,000. Costco sent us the tracking number and everything, and the day it was supposed to arrive, I waited outside when the UPS usually drives through our area. I saw the truck, and it didn't slow down, but went two houses down.
Oh well, I told my wife, who was expecting her new hobby. Maybe it will come tommorrow.
An hour later, our neighbor knocked on the door and handed us the box, with the camera in it. UPS delivered it to the wrong house, even though our address was on it@@
I was mad, what if our neighbor had not been honest?
Those UPS drivers make what, 15 to 20 $ an hour to deliver something, but they aren't accountable for it since they check it off on their little scanner box.....
I was furios, my wife thankful.

If the tracking number shows it was delivered than paypal and ebay will do nothing about it. Sometimes you just get screwed on ebay. You have to remember ebay is 80 percent fraud.

In order to receive your money back you would have to prove the package was not delivered - via tracking number - if paypal checks and sees that the package was delivered you will not get your money back. Sorry

E-bay has a dispute section. I have used this and it worked out fine for me. They follow up on all your details for you and get in touch with the seller. And if your dispute is found to be accurate, they take action against the seller. Good Luck.

Using the tracking number check with the shipping company first. Was the item in the US? Sometimes it is the shipping company. It helps if you ask the seller nicely to help with finding the shipment too.

I'm not sure about all the details, but my husband put in a dispute for not getting a product and eBay refunded the money. They know these things happen and they will hopefully investigate it.
