Doesn't he know that according to the DMCA, he has just commited a criminal act of circumventing an access control which will open him up to lawsuits from both Apple Computer and AT&T? Maybe he was just banking on not being prosecuted since he's only 17...my money is on him being waived into adult court.

No. I think he's doing the public a favor. It's a civil lawsuit, not criminal if they do sue.

You are mistaken about the law. The DMCA specifically excludes cell phones. He is a genius for knowing there was a loophole in the law. Apple and ATT have stated they have no recourse for prosecution. They are instead seeking ways to make the phones "unlockable" in the future. In the meantime - the unlocked I-Phone is up to $13,000 on Ebay and he is headed off to college majoring in neuroscience. Doesn't sound too stupid to me!
