I know in MLB 2K5 Barry is not in there. it has nothing to do with them letting him its all about Barry and getting paid for his likeness. He figures he can get more money on the open market then just by being in a game. That way he has more control over where he would like his likeness displayed.

It's not that hes not allowed to be in those games, he has to agree to be put in the game. Plain and simple. It's not like they don't ask him or something. Players have to give consent to be used in a video game.
