the checks were paid and i was released the same day.the owner fired me because i embarresed him in the community.do i have any legal recourse.can i still draw unemploment? am 64 yrs old and never been arrested,never even had a traffic ticket.not easy to get a job at my age so it really hurts.

not sure what "theft by check charge" means. Are you saying you paid by check but had no money in the bank to cover it?

You can always apply for unemployment, and there you will make a statement (on paper) which will be verified with the employer and then you will get a chance to rebut the employer's comment. It will be the unemployment office that will make the decision if they will give you unemployment comp or not.

I'm not sure if I'm reading your comment right or not.....sounds like you did the deed and now you don't want to be blamed for it. If that's not the way it is, then please explain yourself.

At your age there are two choices (I know from working with seniors), there is an AARP representative at your state job services who may be able to help you get work. And would help you find specialized work if you are a vet. Or, open your own business. If you know a lot of people and can sell then maybe you can bring in some pin money, although it may take you five years before your business becomes stable with profits. How about snagajob.com ?

Auto dealerships have to show the community that they are extremely "above board" simply to counter the unflattering stereotypes. This is even more acute in small towns. Your arrest, even if you ultimately paid the checks off, will lead people to believe that you are a dishonest person. Right or wrong, in his business, keeping someone who is seen in the community as dishonest would have a detremental effect on his business. he has the right to terminate someone who has a negative effect on his business.

He has clearly not discriminated against you for other reasons and has simply sacked you after YOUR actions made keeping you too costly for him.

I understand that you may have difficulty getting a job because of your age, but you will have greater difficulty in a small town where people consider you dishonest. Contact your local unemployment office for advice. Generally if you were fired due to your own actions, you can't collect unemployment. But your state may be different.

Your employer had cause to fire you.

As a sales man at his dealership - your reputation as being honest is very important. Also, dealerships engage in financial transactions. You have proven yourself to be untrustworthy in the financial arena.

What is to keep you from engaging in future theft by check actions...getting yourself into a financial mess...and then embezzling from the dealership to try and bail yourself out. Any job that deals with money is going to be wary of someone with check charges or even a bad credit report.

As your actions caused your termination, you can apply for unemployment, but expect to be turned down.

Where did you steal the ck from? and Have you been convicted of a crime yet? If ck was stolen from the co that fired you, you have no recourse and no unemployment is due, as their was just cause for automatic dismissal.

A boss cannot fire you do to embarrassment.

I sugges you go to your local labor board, located in front of phone book under gov agency, county angency.

You may also be entitled to unemployment. Its worth a try, If they do turn you down , request a hearing.

Your boss sounds like an ***.

Your employer can fire you for a reason like this. You have no contract with him, and he can fire you for pretty much any reason he chooses. However, if it is a case of discrimination, then you have legal recourse under the civil rights laws. You may want to fudge the truth a little, and claim age discrimination. Talk to a lawyer about filing suit. It's a little underhanded, but so is firing you for such a lame reason.

Theft by check sounds a lot more serious if it is the employee who did it. I can understand an employer not wanting an employee who would do such things It was taking a loan when no one wanted to lend, wasn't it?

I don't know what that means, theft by check charge, were you bouncing checks or stealing from his company? He has just cause to fire you either way so it looks like you should apply at Wal-Mart as a "people greeter" or go into flipping burgers for a living. Should have taken care. NO charges/tickets? EVER? c'mon!!!!!

Depends on what state you are in. Alot of states are "right to work" states. That basically means you can be fired for any reason other than race,religion,disability etc....
