Why is it women kill their children(one drowned her FIVE children in a bath tub, the other drove her car into a lake and blamed it on a carjacking that never happened) and get to plead this temporary insanity bullshit. Scott Peterson gets the death penalty though for killing his pregnant wife. The women had emotional ties to their children which he didn't have yet because his child wasn't born yet. I'm not taking up for Scott Peterson but shouldn't all three of them get the death penalty??

The death penalty does not apply to the worst of the worst. It applies to defendents with the worst lawyers. When is the last time a millionaire was on death row. The way our criminal justice system deals with insanity also makes no sense. Here is some info about the way it works.

The legal standard for insanity is stuck in the 19th century, with the McNaughton rule. Under this rule, to be judged insane a defendent must not be able to tell the difference between right and wrong. This standard does not protect defendents with serious mental illness- schizophrenia, bi polar disorder and others. The insanity defense does not usually work.

The law requires only that a person scheduled to be executed must be sane enough at the time of his execution to be aware of what is happening and why. We have executed people who could not meet that standard without being forcibly medicated.

Examples-

Charles Singleton, executed in Arkansas in 2004, forcibly medicated to make him sane enough to die, just prior to his execution

Kelsey Patterson, schizophrenic, executed in Texas in 2004
in and out of state mental hospitals

James Colburn, executed in 2003 in Texas.
chronic paranoid schizophrenia, a serious mental illness whose symptoms include hallucinations and delusions. His mental illness was not disputed by the state

Larry Robison, executed in 2000 in Texas
He was first diagnosed as suffering from paranoid schizophrenia three years before the murders, but the Texas mental health care services repeatedly said that they did not have the resources to treat him unless he turned violent.

Bloody hard question to answer mate,here in australia we have a case now where the father has been charged with killing his kids because his wife left him.He says an accident,the prosicution says murder.We dont have the death penalty in Oz,but it does seem to world wide where women can walk free for killing their kids in some cases but very little lenacy toward men who do the same.

Clearly this is a classic case of the double standard that exists with little dogs. Due to the fact that it is highly unlikely that these little dogs will cause serious injury or death, it is accepted that this behavior continues. However, little dogs, even chihuahuas, should be held accountable to general standards of good behavior and this vicious dog should have been removed at a minimum. All dog owners, even owners of toy breeds, must learn that dominance/aggression can never be tolerated in a social situation.

i agree that they should both face the death penalty. it seems that women get a break when it comes to justice.

just look at the women who have been sleeping with their students. one was too pretty to go to jail????????? if that was a male teacher there would be protest at the sentance.

why not let women experience the true definition of equality that they say they want.

I believe it is double standards, the scales of justice are grossly out of balance. We have jurors who can be influenced by a barrister who is more gifted in charisma than the opposition barrister, and return an unfair verdict.

I dont' think it has anything to do with the sex of a person. You are just naming certain cases where one person got let off and the other person got death penalty. It happens all the time to people who don' tdeserve it and it has nothing to do with the sex of a person.

Depends on the state. Not all states have the death penalty.
