I am currently in the process of filing for divorce. My husband tried the first time and was missing some paperwork. I spoke to a lawyer and was told that the papers have to be filed in the county where the defendent lives. Does this make sense? Anyone else heard this? I'd really like some help understanding why this is...it is hard enough already...WITHOUT being so confused and having to do it multiple times!

I really just want help understanding. Again, this is the SECOND time filed...first time was a bust. Lots of boring details, basically just wondering if this lawyer is the one to go with, or is this bogus info?

the best advise I can give you is to speak to your attorney and let him file the papers...that is why the earn the big bucks

I got married and divorced in SC, but we both lived in the same town. I was the petitioner, although my lawyer did say he would be served the divorce papers anywhere. If he was at work (worked in a different county), they'd serve him there.
This would be a question for your lawyer - that's what you're paying her for, right? :-)

I thought it was the county of the plaintiff (being the person who files)? At least that is how it is in GA. Because if it uncontested then only the plaintiff has to show for court.
