Did you pay with a credit card? If so, you have a ton of protection! I would file a chargeback with your credit card company if the merchant will not fix or refund your $$. You will almost always come out on the good side in that case, the credit card companies tend to be very supportive of their customers.

Of course you have rights and you have to know how to use them. If you paid by credit card you can dispute the payment with the credit card company.

You can contact the Better Business Bureau, Consumer Affairs Agency and also take the store to Small Claims Court. If the store is part of a chain write a letter to the President of the company. Some TV stations and newspapers have consumer help features. You can try that too.

Keep careful records of the persons that you spoke to and their answers. If you have not already done so send a return receipt letter to the store demanding your money back and describe the reasons. You will need to develop and maintain a paper trail.

Good luck.

Contact the consumer protection agency in your state. Contact the Better Business Bureau. Then contact an attorney, because they won't do anything for you. Good luck.

Talk to the vendor. If the matter cannot be set right, your recourse is to cancel the sale. There is no reason to get any branch of government involved.

Where do you live? Some states, like Texas, have "lemon laws" to protect consumers.

Regardless of where you live, you can always take them to small claims court.
