It's illegal to deliberately approach whales in a boat, so you won't get any closer than they're willing to come to you. There are tours around Baja where they go out in small boats and sit and wait for the whales. Occasionally the gray whales will come close enough to be petted (see link), but it's at the whales' discretion, not yours, so there are no guarantees that you'll do anything more than see them.
