The GOP no longer recognizes the 10th Amendment. They stopped that with the ascension of Lincoln. Nixon, Reagan, Bush and the rest have further destroyed that.
Dems arent helping. Carter probably didnt even know there was a 10th Amendment when he did some things.
__
This is a civil rights issue though. 10th Amendment does not apply and it should not be allowed to be banned by the states, only churches who can hold any crazy idea they want.

People are making gay marraige an issue that is not necessary. But I believe that it should be up to the state whether they dont want to allow gay marriage. I am a believer in gay marraige. I believe that if you love someone you have a right to marry them. Not matter what their gender. Saying gays cant get married is like sayings africans americans cant married or blind people cant get married or people with aids can get married. You cant control your character. Some people dont choose to be gay. It may sound ubsurd but it is true.

Marriage is a biblical term. It is defined as between a man and a woman. They can do anything they like behind closed doors, but the publicly identified union of marriage should not apply to gays.
If Vermont allows gay marriage and the involved people move to traditional Tennessee, will they still be married? That is why this is a federal issue.

Excellent question and I have raised this issue before.
My marriage license is issued by the state of Nevada, not the federal government. It is just another power grab by the big government Republicans.

Neither.
Leave marriages to the churches.
Leave Civil Unions to the government. Civil Unions are the Union between any two consenting adults.

I don't believe in State's Rights as a viable means to operate with our "Global Village" that the world has now become...
The 13th Ammend guarantees "Equal protection" and thus equal rights for all... Period!

I think we should start living everyone's rights up to the individual state they live in--just imagine how well that would work out.
