Once you get arrested, the arrest is "on your record" forever. So is the disposition if you are found guilty.

It will always show up on your driving record but .................. if you got another DUI it would be a first offense after 3 years. Within 3 years it would be your 3nd. They can not use it against you after 3 years but it will always be on your driving record. It sucks. It is also not seen on your insurance after 3 years. I had a DUI over 12 years ago and it still haunts me every once in a while. It never goes away. Trust me.
