We have an ad out for a senior sales position and we received an application from an employee of a major competitor. Is it OK to hire him/her?

Yes! Most major corporations have people out there actively recruiting from their competitors. I have had two jobs in which finding recruitment candidates was a part of my job even though my actual position had nothing to do with HR. Just be aware of any non-compete clauses they may have. You'd be crazy to pass up a qualified candidate just because they came froma competitor.

Not only is it OK, it makes very good business sense, because your competitor paid handsomely to train that sales person. He/she already understands the industry, the customers, and most likely has existing relationships that would benefit your company.

As was stated above, if there is no non-compete clause, then its open season.

Just remember, your competitor can do the same to you.

He might have a non-compete agreement with his current employer. So long as he doesn't and have a reasonable explanation why he is seeking out to you, it should be OK.

As long as it wouldn't be a conflict of interest I don't see anything in hiring that person

That person is looking to improve his lot in life. Why not? There may be problems where he is working. No one works for one company forevery anymore. Why not listen to what he has to say. . .

Unless he or she has a contract with a non-compete clause, it's OK.
