The mother of a friend of my son has ordered a restraining order against my son, simply because she does not like my son, my son and her son are very good friends, there is no any sort of harassment , abuse or threat involved at all,
a detective showed the other day to give the order to my son, my son was at school at that time, the detective said he will come next day when my son is at home,
can my son or (we) refuse the restraining order?
and what happens if we do, thanks,

A judge made that, so violating it is going to put you in trouble with the law. Don't be asking this question on Yahoo Answers, ask a GOOD lawyer about what to do to fight this. This woman sounds like she is trying to make you move, which would be a huge disruption in your, and your son's life, which isn't fair. It's up to her to move, not you.

Restraining orders aren't an "optional" situation - it is ordered by the court. There is something seriously wrong with this situation - judges don't issues restraining orders for no reason, so I think there might be some missing details here. Talk with an attorney, see about contesting it in court and if it is frivolous, possibly sue her for slander.

What would the point of a restraining order be if the receiving party could just refuse it?

No you do not have the right to refuse a court order. Just follow the order and everything will be OK.

no but go to the magistrates office and explain the situation and that the boys are in the same classes together and your son would be required to change his classes, which would cause him emotional and intellectual issues in school. This is just obserd and ask if there is anything you could do to change it.

no, you can't refuse a restraining order. It's a court order document.

No. That is a decision for the judge to make. You have the right to contest it in front of the judge, but you can't just refuse.

You can't refuse it.

there has to be more to the story though, no judge will issue a TRO without a reason....
