Unless the state has severed all parental rights he would have to get the biological father's permission to adopt, which isn't a bad thing for him. It would mean the child support would stop.
The best thing to do though is get with an attorney who can tell you what your state's laws are when it comes to adoption. Each state is different to a certain extent.

He can't...not even if he has never seen his father, You need permission or you need to have his Fathers rights terminated. And if pays child support no matter how sporadic, your doomed. Women on here seem to think that because the father is not involved you can do anything you want....trust me you can't. If the father is willing to give up his rights, it still has to go in front of a Judge. Sorry....just went through this with Daughter and grandson.

If the biological father has had nothing to do with the child I guess he can.
To play it safe, get papers drawn up so for the biological father to sign saying he has no objection to the adoption.

He can't. The biolgoical father HAS to sign off on parental rights in order for the non-biological male to adopt.

You have to have the biological father's permission BUT, I think in rare exceptions such as 'abandonment' it's different. There is a law category on here,you'd have better luck asking them.
Is the name of the biological father on the birth certificate, if not then ....you may not need his permission.

No he can't. Your sons bilological father would have to legally give up his parental rights in order for your husband can adopt him.

No he cannot. He needs to have a waiver from the father stating that he will no longer have any legal rights to your child.
