My mom died and my seventeen year old daughter lived with her , during her last two months of life, helping care for her, and so she would have someone with her at night. Now that she has passed, the apartments let my kid stay there, and start a new lease. so she went to get cable in her name, and they told her until she pays off my moms cable bill, she can never have service there. Is this legal? she wasnt on the contract, the cable was there before she moved there, and it makes no sense to me.

Many people move into an apartment where the previous owners jimmied the cable to get it free. Then the new occupants watch the TV for free until the company comes to check it (they always do). Then they'll usually stick you with the bill from when you moved in. If your mom watched it for free for a long time you may have to pay the whole thing.

Two schools of thought here for me:

1. That's not right. It's no different than if total strangers moved in and needed service, they would not turn them down. They are doing this because they know she is family and they think they can get the money out of her that way. They are certainly entitled to receive payment from your mom's estate if there even is one, but if there was nothing to open an estate over, they would have to take the loss. However, they are entitled to require a deposit on a new customer if they wish, and your daughter would probably have to be 18 if she isn't already.

2. Under the circumstances, they know, and could probably prove through the landlord that your daughter has had use of their service the whole time since grandma's death. Still not her contractual obligation, but the truth.

Bottom line: It is FAR cheaper to suck it up and pay the bill than it would be to try to fight it. You can show them the death certificate and raise a lot of hell and see what happens first though!

Sorry to hear about your loss.

From my understanding she'd have to pay off the remainder of the bill in order to get the cable switched over to her name.
I'm not sure I believe that cable was there beforehand unless someone had paid the remainder of the month and it just stayed on.

I know someone that was in a simular situation. What she ended up doing was getting the new rental lease showing that the apt was now in her name. Your daughter should not be responsable for your mothers bill.

I dont think anyone should legally have to pay anyones bill if thier name is not on a contract who knows what this world is comming too

please accept my condolences for your loss.

if the cable account was in your moms name then all your daughter has to do is produce (when a sufficient period of mourning has passed) your moms certificate of passing and the cable company would have no choice but to close the account-a new account in your daughters name can then be opened.
