in my house. Do I need a contract with the person to sign they cannot go into my house ONLY upstairs to theirs only? That they cannot drink or smoke or play loud music at all? What kind of contract do I need, and where do I get one and how much are they? Also, It will be month to month rent payment, so that way, Heaven forbid, they can't pay I can ask for them to find another location.

I live in California. Any advice helpful.

Honey, I've been in both places, the rentor, and the rentee, so to speak. NEVER assume that the other person know the rules. Always have EVERYTHING in writing, even in a month-to-month rental, which is what you are talking about. Rules will differ from state to state, but you really need the house rules established prior to the individual moving in, and they should be signed, and preferably, witnessed. It would be so wonderful if the upstairs rental had an outside entrance and no access to your downstairs. Sometimes that just is totally cost prohibitive. Goodluck!!!!

I like to think that 94% of humans are very reasonable. (it is only 6% causing most of the world problems)
Make a list of what YOU will and will not do, includuing details of asking the person to leave.
and make another list for the person to do and not do. Show this person the list and have them sign it.

You will need an agreement. Try this site for one of their free, downloadable forms. It should have the language you are looking for or you can just one of them to use as a template and add stuff that you think is important.

In California, they are legally not allowed to enter your house. There are many restrictions; you need to educate yourself on renter's rights and agreements.
