in my house. Do I need a contract with the person to sign they cannot go into my house ONLY upstairs to theirs only? That they cannot drink or smoke or play loud music at all? What kind of contract do I need, and where do I get one and how much are they? Also, It will be month to month rent payment, so that way, Heaven forbid, they can't pay I can ask for them to find another location.

I live in California. Any advice helpful.

Good luck, being a landlord in California sucks, it may be easy to find a non smoker but I think you may have problems finding someone that is willing to live in silence. and if a person can't pay, if they live there for more then 30 days you would have to evict them and that can take up to 90 days. as far as being in your house, as long as they have a separt entrance I don't see that as a problem, and I'm not sure if it's legal to rent out a space with no kitchen facilitys.

You are going to rent space in your home and
That space is not a separate locked entrance and
You don't know them ?

I lay odds your ID is stolen , along with other things very shortly . ( unless your FICO is like 500 )

If they can't pay , you can go to court to get an eviction notice ( you'll probably need an attorney)
And count on revenge when you evict them .

I do hope you are a 250 lb ex Marine , skilled in the art of self defense .

AND I just noticed the california part ,
Figure on a 6 month time to evict after they stop paying .

To be honest, this sounds like a pretty sketchy situation. But, you will need a rental agreement, at the very least.
