I think my hubby screwed us.

We needed some money fast,so he wrote a cheque(no money in the bank...)wrote it to me and signed it himself to be put into his account(we have done this with goverment cheques anyway,he wrote another cheque to cover that one and so on. Now the most recent cheque bounced. What can we anticipate happening? We have every intention of paying it back. can a bank lay charges if we pay it back. I kept telling him not to do this. He phoned them today and they said that's fine we can pay it. but wasn't the cheque illegal?

I am so confused.

the cheque did not go from one bank to another,it was his account,cheque made out me and he signed it to be deposited into his account. He had put in another cheque that wasn't enough for the previous so it bounced.

Hopefully what will happen is that you will ultimately learn to never do this again. You can expect your banks to assess NSF fees at least twice for each check, because they generally resubmit if the check bounces once. You need to quickly come up with enough money to cover the check and the expected NSF fees. Back in the old days, you could get by with what you tried to do. But now checks can clear very quickly.

Yes, what you did was illegal but intent needs to be proved. You will likely never be charged for the offense unless you refuse to make good on the check.

I'm a little confused. Your husband wrote a check to you and then deposited the check in the same bank account it was written on? The bank shouldn't have even accepted that deposit.

I've heard of folks cashing a check at a store and running to the bank to put the cash in the account to cover a previous check. That's called floating and doesn't work here in the US anymoe since checks are electronically processed now.

Intention is a very important element if there was an intention to defraud the that is illegal also it does have something to do with the value of the cheque but i am not sure what that value may be. What you have don seams a little dubious but if the bank is indicating they are fine with it cool.

Yes but the banks will let it go if you pay all the fees to it. It's not trouble if you pay off the bounced check ONly if you don't then your in trouble.

I suspect from the spelling of cheque you are not in the USA but if it where here it would be a crime and it is called kiting!
