The father of my niece called and said my sister did drugs, and they also said there were multiple reports of child abandonment. My sister volunteered to take a drug test, and they refused. They gave my niece to her father who is an illegal immigrant who isn't even on the birth certificate.There was no investigation, or report of findings, or a court hearing or anything their own pamphlet said was proper procedure. We called a couple of lawyers that did a free intial consultation and the number your supposed to call if you don't agree with how your case was handled, and nobody had called back. It's been over a month now, and the father won't let my sister see my niece, she's only 2 and has never been away from her mom. He has mentioned taking her to Mexico. We already went to the court house to file for custody and they said she needed to establish paternity first. Please help, anyone know anything?

There seems to be a lot missing from this story. Either way you need to get a lawyer and go to court.

I find it odd that CPS would award custody to someone they can't prove is a blood relative, and not on the birth certificate as a biological parent. I don't know what kinds of lawyers you guys have been using, but you might want to contact a family court lawyer, they would know their way around CPS better than the average lawyer. well i think you guys need to find a good lawyer, and i don't think the father can take her for so long to mexico coz she is an american so just take the case to the court and explain them that your sis never did any drugs even if she did but make sure she is clean from drugs and help her stay clean, and i really hope you can recuperate your niece.

There has to be more to the story than what you are telling us; the father would have had to have gone to Court to get custody and if the mother had custody, she would need to be proven unfit for custody.

If your sister wants custody back, she needs to hire her own attorney to straighten the matter now and gone forward
