i downloaded a patch for a capture card i was going to use.

well i dont have a virus scanner on the computer, and i forgot that i had uninstalled it a week ago.

i right clicked the file and clicked scan, then remembered oh i dont have a scanner.

so i wanted to just delete it instead of use it, but now it says its in use by another process, ive rebooted a few times and just want it to go away.

basically how do i figure out what process is running the file so i can just end the process and delete the file

You can delete it manually or get a program to do it for you. Follow the link below for instructions.

The easiest way is to get a program, I recommend Remove on Reboot Shell Extension and you can get it here: http://www.snapfiles.com/get/removereboot.html

Try this: from start go to 'run' and type in services.msc then hit 'enter'. under the processes tab of the popup window that comes up, look for the program that you wish to delete. Then high light it and right click on it and select to stop it. You should then be able to delete it.
