If the police asks them, they are not human. What are they?

Well Korben Dallas was human Leeloo definitely was more than human. Korben had said what he did because he was trying to stay under the police radar, which is why he said , " I am a meat popsicle". Leeloo had been in hiding so they would not have been able to ask her anything.
In any event, she was considered human just a superhuman- the Perfect being, hence the 5th element.
