My sister got in an accident, and she doesnt know if it was her fault. She said that she was going at about 15 mph, and the guy slammed on his brakes which caused her to do the same, except when she did, her brakes locked up. It was just a fender bender but she got a ticket and she has to take a course to keep her license. Im not sure if its careless driving, can someone clear it up for me?

I dont know if this is a univeral law, but to my knowledge, if you hit the person in front of you, you are deemed to be at fault.... no matter how fast / slow you were going, you (she) must have been too close to the car in front and that is the main reason she hit them.....

Your sister is at fault for failing to maintain a safe distance from the car in front of her.

The only way she can win this one is to prove that the guy in front of her slammed on his brakes for no good reason, and that he did just to cause an accident. There are people out there that run insurance scams doing just that. Sometimes they have another person drive along side the target car, so that they can't swerve out of the way to avoid the accident. It is hard to prove, and if that was the case, I hope that she can prove it. good luck.

usually when the car in the rear runs into the car in front, it is the rear drivers fault. the logic is that the driver was not maintaining a safe distance and that is why she got a ticket.

unless there were witnesses, he could get away with just slamming on the brakes and say an animal ran out in front of the car.

Anyone who is hit from behind the back driver is at fault, no matter what. Your sister shouldn't have been following to close. Trust me, I know how she feels I have had my share of opps accidents. From now on I can guarantee that she will have a good distance between her and the other car!

She probably received the citation for following too closely or too fast for the conditions. Unfortunately, except for rare cases, the individual in the following vehicle is found at fault.
At 15 mph, she should not have skidded that far. So not paying attention or following too closely is the likely answer.

If she was unable to control her vehicle and ran into someone else, it would be her fault. Her getting a ticket is the frosting on that cake, she IS at fault for following too close. Why would she not know it was her fault? Seems quite obvious.

by law you are supposed to have your car under control at all times no matter what the other guy does. like in ur sisters case the guy in front slammed on his brakes not that she should be expecting that but she should always be ready to take evasive maneuvers

well the only thing that you could really do is get the brakes checked and see if that really happened you wouldnt really know if she is telling the truth about it or not unless you are there most people make up lies when they get tickets so they dont get in as much trouble

she was obviously following to close. also she failed to maintain control of her vehicle and in turn hit another one. Of course she is at fault. Next time tell her not to tailgate the vehicle in front of her and this kind of thing wont happen again

anytime there is a fender bender the person behind the one that got hit gets charged.she will propally have to pay a fine.and propally a course.
